1. Agreement to Terms

By accessing or using WipeGolf (the "App," "Service," or "Platform"), whether through mobile devices, Apple Watch, or any other means, you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, please don't use WipeGolf.

What This Agreement Covers

• Your use of the WipeGolf mobile app (iOS)
• Your use of the WipeGolf Apple Watch app
• Any services, features, or content we provide
• Your account and subscription (if applicable)

These Terms constitute a legally binding agreement between you and WipeGolf. By creating an account or using our services, you represent that you are at least 13 years old and have the legal capacity to enter into this agreement.

2. License to Use WipeGolf

What You Can Do

We grant you a limited, non-exclusive, non-transferable, revocable license to:

✅ Download and install WipeGolf on your personal devices
✅ Use WipeGolf for personal, non-commercial purposes
✅ Access and use all features included in your subscription tier
✅ Create, store, and share your golf performance data

What You Cannot Do

You agree NOT to:

❌ Modify, adapt, hack, or reverse engineer the App
❌ Remove any copyright, trademark, or proprietary notices
❌ Use the App for commercial purposes without permission
❌ Copy, distribute, or sublicense the App
❌ Create derivative works based on the App
❌ Use automated systems (bots, scrapers) to access the service
❌ Attempt to gain unauthorized access to our systems
❌ Interfere with or disrupt the App's functionality

3. Your Account

Account Creation

To use WipeGolf, you must create an account using Google Sign-In or Apple Sign-In. When creating your account, you must:

• Provide accurate, complete, and current information
• Maintain and promptly update your account information
• Be at least 13 years old (or the age of majority in your jurisdiction)
• Choose a username that doesn't infringe on others' rights

Account Security

• Keep your authentication credentials secure
• Don't share your account with others
• Notify us immediately if you suspect unauthorized access
• You're responsible for all activities under your account

Account Suspension or Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• You abuse or harass other users
• Your account has been inactive for an extended period
• We're required to do so by law

4. Subscriptions & Payments

Premium Subscription

WipeGolf offers a premium subscription that unlocks advanced features including:

• Advanced Analytics: Detailed swing analysis and metrics
• Unlimited Tracking: No limits on practice sessions or swings
• Smart Recommendations: Personalized tips and insights
• Goals & Challenges: Custom practice goals and achievements
• Email Reports: Detailed performance summaries via email
• Cloud Sync: Seamless data synchronization across devices

• Billed monthly
• 7-day free trial for new users
• Cancel anytime
• Auto-renews unless cancelled

Yearly Plan

• Billed annually
• 7-day free trial for new users
• Best value option
• Auto-renews unless cancelled

Free Trial

New users are eligible for a 7-day free trial of WipeGolf Premium. During the trial:

• You have full access to all premium features
• You won't be charged during the 7-day trial period
• You can cancel anytime during the trial at no cost
• If you don't cancel, your subscription will auto-renew and you'll be charged
• Only one free trial per user

Billing & Payment

Important Billing Information

• Payment Processor: All payments are processed through Apple App Store
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Pricing: Subscription prices are listed in the App and may vary by region
• Price Changes: We'll notify you of any price changes in advance
• Taxes: Prices may not include applicable taxes, which will be added at checkout

Cancellation & Refunds

How to Cancel:

1. Open Settings app on your iPhone
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select WipeGolf
5. Tap "Cancel Subscription"

Refund Policy

• Refunds are handled by Apple according to their policies
• Generally, subscriptions are non-refundable
• You may request a refund through Apple within specific timeframes
• Contact Apple Support for refund requests
• After cancellation, you retain access until the end of your billing period

5. Your Data & Privacy

What Data We Collect

WipeGolf collects and stores:

• Account information: Name, email, username, profile details
• Golf performance data: Swing metrics, tempo, speed, session history
• Device information: Device type, OS version, app usage
• Apple Watch data: Motion sensor data during practice sessions

Your Data Rights

You Own Your Data

• Access: You can view and download your data anytime
• Export: Export your data in CSV format
• Delete: Request deletion of your account and all data
• Portability: Take your data with you if you leave

We use your data solely to provide and improve WipeGolf services. We never sell your personal information. For complete details, please read our Privacy Policy.

6. Apple Watch Integration

Requirements & Functionality

WipeGolf uses Apple Watch to provide real-time swing analysis. By using this feature, you acknowledge:

• Device Requirements: Apple Watch Series 4 or newer required
• Sensor Data: The app collects motion sensor data (accelerometer, gyroscope)
• Optimal Use: Wear the watch on your lead wrist for best results
• Battery Usage: Active tracking may drain Apple Watch battery faster
• Accuracy: Results depend on proper wear and sensor calibration

⚠️ Current Limitations

• Currently supports right-handed golfers only (left-handed coming soon)
• Designed for left wrist wear (right wrist support coming soon)
• Requires iPhone paired with Apple Watch for full functionality

7. Acceptable Use Policy

Prohibited Conduct

You agree NOT to use WipeGolf to:

❌ Violate any local, state, national, or international law
❌ Harass, abuse, threaten, or intimidate other users
❌ Impersonate any person or entity
❌ Post or transmit harmful, offensive, or illegal content
❌ Collect or store personal data of other users
❌ Interfere with other users' enjoyment of the service
❌ Upload viruses, malware, or malicious code
❌ Attempt to gain unauthorized access to accounts or systems
❌ Use the service for fraudulent purposes
❌ Manipulate or exploit bugs for unfair advantage
❌ Create multiple accounts to abuse free trials

User-Generated Content

If you share content (usernames, profile information, comments) through WipeGolf:

• You retain ownership of your content
• You grant us a license to display and use your content within the service
• You're responsible for the content you share
• Your content must not violate others' rights or our policies
• We may remove content that violates these Terms

Consequences of Violation

If you violate these rules, we may:

• Issue a warning
• Temporarily suspend your account
• Permanently terminate your account
• Remove offensive content
• Report illegal activity to authorities
• Take legal action if necessary

8. Intellectual Property Rights

Our IP Rights

WipeGolf and all its components are protected by intellectual property laws. This includes:

• The WipeGolf name, logo, and branding
• The app's design, interface, and user experience
• All source code, algorithms, and software
• Content, text, graphics, and visual elements
• Swing analysis algorithms and methodologies
• Documentation and instructional materials

Your IP Rights

You retain all intellectual property rights to:

• Your golf performance data and statistics
• Any content you create or share
• Your personal information and profile

Trademarks

WipeGolf® and related marks are trademarks of WipeGolf. You may not use our trademarks without prior written permission. Apple, Apple Watch, iPhone, and related marks are trademarks of Apple Inc.

9. Termination

Your Right to Terminate

You Can Leave Anytime

You may delete your account at any time through the app settings. Upon deletion:

• Your account will be permanently deleted
• All your data will be removed within 30 days
• Active subscriptions will be cancelled (no refund for current period)
• This action cannot be undone

Our Right to Terminate

We may suspend or terminate your account immediately if:

• You materially breach these Terms
• You engage in fraudulent or illegal activity
• You repeatedly violate our policies
• We're required to do so by law
• We discontinue the service (with notice)

We'll provide notice when possible, but may terminate immediately in serious cases.

Effect of Termination

Upon termination of your account:

• Your license to use WipeGolf ends immediately
• You must stop using the service
• You lose access to your account and data
• Provisions that should survive (liability, disputes) remain in effect

10. Disclaimers & Limitation of Liability

Service "As Is"

• The accuracy, completeness, or reliability of the service
• Uninterrupted or error-free operation
• The accuracy of swing analysis or recommendations
• Fitness for a particular purpose
• Non-infringement of third-party rights

Not Professional Advice

WipeGolf provides swing analysis and recommendations for informational purposes only. We are not professional golf instructors, and our recommendations should not replace professional coaching. Always consult with a qualified golf professional for personalized instruction.

Limitation of Liability

Maximum Liability Cap

To the fullest extent permitted by law, WipeGolf, its officers, directors, employees, and agents shall not be liable for:

• Indirect damages: Loss of profits, data, use, goodwill, or other intangible losses
• Incidental damages: Costs resulting from the use or inability to use the service
• Consequential damages: Any damages resulting from service interruptions or errors
• Punitive damages: Even if we've been advised of the possibility

Our maximum liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose, or $100, whichever is greater.

Indemnification

You agree to indemnify and hold harmless WipeGolf from any claims, damages, or expenses (including legal fees) arising from your use of the service, violation of these Terms, or infringement of any rights of another.

11. Dispute Resolution

Informal Resolution

If you have a dispute with WipeGolf, please contact us first at support@wipegolf.com. We'll work in good faith to resolve the issue informally.

Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law principles.

Arbitration Agreement

Binding Arbitration

Any dispute that cannot be resolved informally will be resolved through binding arbitration, except:

• Small claims court disputes (under the jurisdictional limit)
• Intellectual property disputes
• Disputes seeking injunctive relief

Arbitration will be conducted by a neutral arbitrator and will take place in [Your Location]. Each party bears their own costs unless otherwise awarded by the arbitrator.

Class Action Waiver

You agree that any arbitration or legal proceeding will be limited to the dispute between you and WipeGolf individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. General Provisions

Changes to Terms

We may update these Terms from time to time. When we do:

• We'll update the "Last updated" date at the top
• We'll notify you via email or in-app notification for material changes
• Continued use after changes constitutes acceptance
• If you don't agree to changes, stop using the service

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WipeGolf regarding the service.

Assignment

You may not assign these Terms without our consent. We may assign these Terms to any successor or acquirer.

Waiver

Our failure to enforce any provision doesn't waive our right to enforce it later.

Force Majeure

We're not liable for delays or failures caused by circumstances beyond our reasonable control (natural disasters, wars, pandemics, internet outages, etc.).
